Cancellation Policy

Standard cancellation and refund rules for reservations made through Adriavela

Effective date: 23 June 2026

Please read this document before submitting a Booking or making a payment through the Adriavela Platform.
Key principles • Once a reservation is confirmed, the Charter Agreement is directly between the Customer and the Operator. • Adriavela is not responsible for performance, cancellation or termination of the Charter Agreement. • The Adriavela Commission is fully earned upon confirmation and is non-refundable to the maximum extent permitted by law. • Adriavela may facilitate communications and payment administration but does not guarantee an Operator refund.

1. Scope and Incorporation

This Cancellation Policy applies to every reservation made through the Adriavela Platform and forms part of the Adriavela Terms of Service. Adriavela does not publish or apply separate Operator cancellation policies on individual Yacht Listings.

The version of this Policy in force when the reservation is confirmed applies to that reservation. Capitalized terms have the meanings given in the Terms of Service unless defined in this Policy.

2. Price Components

• The “Operator Portion” is the part of the Total Reservation Price attributable to the yacht and charter services supplied by the Operator.

• The “Adriavela Commission” is the commission, marketplace fee or service fee earned by Adriavela for facilitating and administering the reservation, whether shown separately or included in the Total Reservation Price.

• A refund of the Operator Portion does not include the Adriavela Commission.

3. How to Submit a Cancellation or Change Request

Every cancellation, rescheduling or material change request must be sent in writing to info@adriavela.com. The request should include the reservation number, Customer name, yacht, charter dates, reason for the request and relevant supporting documents.

A request is treated as received when it reaches Adriavela’s email system. A cancellation becomes administratively recorded when Adriavela acknowledges it in writing. Acknowledgement of receipt does not mean that the Operator has accepted the cancellation, agreed to a refund or released the Customer from obligations under the Charter Agreement.

Adriavela may forward the request to the Operator and facilitate communication. The Customer should also respond promptly to any request from the Operator or Adriavela for additional information.

4. Effect of Reservation Confirmation

Before confirmation, Adriavela may reject or cancel the Booking and release or reverse any uncaptured authorization. No Charter Agreement exists until confirmation.

Upon confirmation, a direct Charter Agreement is formed between the Customer and the Operator. Adriavela’s core reservation-facilitation service has been performed, and the Operator becomes solely responsible for providing the yacht and charter services.

After confirmation, the cancellation, termination, amendment or non-performance of the charter is a matter between the Customer and the Operator. Adriavela is not responsible for deciding whether either party has valid grounds to cancel or for guaranteeing payment by the Operator.

5. Non-Refundable Adriavela Commission

The Adriavela Commission is fully earned when the reservation is confirmed and is non-refundable to the maximum extent permitted by law.

The Adriavela Commission will not be refunded when a reservation is cancelled, changed, shortened, rescheduled, interrupted or not used, regardless of whether this results from:

• a decision or request by the Customer;

• a cancellation, substitution or operational decision by the Operator;

• insufficient Customer qualifications, missing documents, late arrival or failure to attend;

• weather, force majeure, marina restrictions or navigation decisions;

• a yacht discrepancy, breakdown or interruption of the charter;

• a disagreement between the Customer and the Operator;

• a refund, credit or replacement offered by the Operator; or

• any other event occurring after confirmation.

Where a refund of the Operator Portion is payable, Adriavela may deduct or retain the Adriavela Commission before processing the refund. Nothing in this section overrides a mandatory legal rule that expressly requires repayment of the commission in a particular case.

6. Cancellation by the Customer

A Customer may request cancellation at any time by following section 3. Cancellation by the Customer does not create an automatic right to repayment of the Operator Portion.

After confirmation, any entitlement to a refund, credit, rescheduling or reduction of the Operator Portion must be agreed with the Operator or arise under the direct Charter Agreement or mandatory law. Adriavela may seek the Operator’s instructions but cannot compel the Operator to approve a refund or change.

Failure to attend, late arrival, travel disruption, illness, lack of travel documents, insufficient sailing qualifications, refusal to sign required Operator documents, or inability to pay a security deposit does not create a right to repayment by Adriavela. The Customer should obtain suitable travel and cancellation insurance where appropriate.

7. Cancellation by the Operator

If the Operator cannot perform the confirmed Charter Agreement, the Operator must inform the Customer and Adriavela promptly. The Operator may propose a reasonably comparable replacement yacht, new dates, a credit or another solution.

If no acceptable alternative is agreed and the Charter Agreement is cancelled by the Operator, responsibility for repayment of the Operator Portion rests with the Operator, subject to mandatory law. Adriavela may process the repayment only after the Operator confirms the amount and authorizes the refund, or after Adriavela otherwise receives sufficient funds and a clear legal basis to do so.

The Adriavela Commission remains non-refundable. Administrative assistance or processing of the Operator Portion does not make Adriavela liable for the Operator’s cancellation or payment obligation.

8. Force Majeure and Severe Weather

A force majeure event includes war, terrorism, sanctions, epidemic, pandemic, natural disaster, severe weather, fire, flood, marina or border closure, government restriction, navigation prohibition, labor dispute, infrastructure failure, cyber incident or another event beyond the reasonable control of the affected party.

Weather warnings, unsafe navigation conditions or force majeure do not automatically create a right to repayment by Adriavela. The Operator, skipper, marina authority or competent public authority determines whether navigation may safely proceed.

The Customer and Operator must resolve whether the charter will proceed, be rerouted, postponed, substituted, credited or cancelled and whether any Operator Portion will be repaid. The Adriavela Commission remains non-refundable to the maximum extent permitted by law.

9. Yacht Does Not Match the Booking Information

If, before departure, the yacht materially differs from the confirmed booking information, has an obvious significant maintenance problem, or appears to lack legally required safety equipment, the Customer must notify the Operator immediately and, where reasonably possible, before accepting handover or departing. The Customer should also email supporting evidence to info@adriavela.com without undue delay.

The Operator must be given a reasonable opportunity to inspect and remedy the issue, provide missing equipment, correct the information or offer a substitute. If the Customer accepts the yacht or substitute and proceeds after the relevant condition has been disclosed, the Customer may lose the right to rely on that accepted condition as grounds for cancellation or refund, to the extent permitted by law.

Any cancellation, price reduction, replacement or repayment of the Operator Portion must be resolved with the Operator. Adriavela may facilitate communication but is not liable for the yacht’s condition or conformity. The Adriavela Commission remains non-refundable.

10. Breakdown or Interruption During the Charter

A breakdown, equipment failure or other interruption during the charter must be reported immediately to the Operator and documented where reasonably possible. The Customer must follow safety instructions and allow the Operator a reasonable opportunity to repair the yacht, provide assistance, change the route, provide a substitute or propose another remedy.

Any entitlement to terminate the Charter Agreement, receive compensation, obtain a pro-rata repayment or recover other amounts is a claim against the Operator under the Charter Agreement and mandatory law. Adriavela may assist administratively but does not determine technical fault, duration of loss of use or the amount payable.

The Adriavela Commission remains non-refundable even if the Operator refunds all or part of the Operator Portion.

11. Cancellation or Administrative Action by Adriavela

Before confirmation, Adriavela may reject or cancel a Booking for any legitimate reason, including failed authorization, incomplete information, suspected fraud, sanctions risk, legal restrictions, technical error or non-acceptance by the Operator. Any uncaptured authorization will be released or reversed in accordance with payment-provider procedures.

After confirmation, Adriavela may suspend Platform access, payment processing or administrative support where required by law, sanctions, fraud prevention, payment-provider rules, safety concerns or material breach of the Terms. Such action does not by itself transfer the Operator’s obligations to Adriavela or make Adriavela a party to the Charter Agreement.

Where a Confirmed Reservation must be cancelled following such action, the Customer and Operator remain responsible for resolving the Charter Agreement and the Operator Portion. The Adriavela Commission remains non-refundable to the maximum extent permitted by law.

12. Refund Processing

Adriavela will process a refund of the Operator Portion only when the amount and entitlement have been confirmed by the Operator or otherwise established under mandatory law, and when the required funds are available to Adriavela.

Refunds are normally issued to the original payment method. After all required conditions are satisfied, Adriavela will instruct the payment provider without undue delay and normally within 15 business days. The payment provider or issuing bank may require additional processing time.

Currency conversion, bank, card-network or payment-provider charges outside Adriavela’s control may affect the amount received. Adriavela is not responsible for exchange-rate differences or third-party processing delays.

13. Chargebacks and Disputes

A Customer must contact info@adriavela.com and attempt in good faith to resolve the matter with the Operator and Adriavela before initiating a chargeback or payment dispute.

A chargeback is not a substitute for the cancellation process and does not change the direct contractual relationship between the Customer and the Operator. Adriavela may contest a chargeback using booking, payment, authentication, communication, check-in and charter records.

Where legally permitted, the Customer remains liable for costs and losses caused by a fraudulent or clearly unjustified chargeback.

14. Mandatory Rights and Interpretation

Nothing in this Policy excludes or restricts a right or remedy that cannot lawfully be excluded under applicable consumer law. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue in effect.

Adriavela’s non-responsibility for the Charter Agreement does not exclude liability for Adriavela’s own fraud, wilful misconduct, gross negligence or breach of a mandatory legal obligation.
